These Terms and Conditions ("Terms") govern your use of PLSR App Basic, a productivity tool developed by DataSpatz. By accessing or using the software, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the software.
"Software" means (1) all of the contents of the setup, files, disk , CD-ROM or other media with which this Agreement is provided, including but not limited to (i) DataSpatz or third party computer information or software; (ii) related explanatory written materials or files ("Documentation"); and
(2) upgrades, modified versions, updates, additions, and copies of the Software, if any, licensed to you by DataSpatz (collectively, "Updates"). "Use" or "Using" means to access, install, download, copy or otherwise benefit from using the functionality of the Software in accordance with the Documentation. "Permitted Number" means one (1) unless otherwise indicated under a valid license (e.g. volume license) granted by DataSpatz. "Computer" means an electronic device that accepts and process information in digital or similar form and manipulates it for a specific result based on a sequence of instructions. "DataSpatz" means DataSpatz, 277 Viram Khand, Gomti Nagar, Lucknow 226010, (U.P. State) India.
PLSR App Basic is a Windows-based desktop application designed to assist pathology labs in entering, saving, and printing patient pathological investigation reports.
The software includes features such as:
* Option to print reports without saving
* Customization of examinations and print options
* Graphical User Interface (GUI) for ease of use
* Pre-filled common examinations and groups
* No third-party controls, using system controls only
* The software is provided "as is," and the security and data integrity of the software solely lie with the end user.
* End users are responsible for ensuring that their systems meet the minimum requirements for running the software, including Microsoft Windows 10 operating system or later, Net Core Framework 6 or later, 8 GB or more RAM, Core i3 or later or equivalent AMD processor, and a laser printer for printing reports.
* Specific customization may incur additional charges.
* A 30-day free trial is available for users to evaluate the software.
* Yearly subscription plans and one-time purchase options are available.
* If a subscription plan is purchased, a yearly license renewal is required after the first year.
* Payment for subscription plans or one-time purchases must be made in full before access to the software is granted.
* Payment for yearly renewal must be made in advance before the expiry date.
* Payments are accepted via VISA enabled Debit card, Credit card, or Internet banking or Paypal.
* All payments are non-refundable.
* The software stores patient records locally, and no data is shared with DataSpatz.
* Access to the software is protected by login credentials provided by the user.
The Software is being delivered to you "AS IS" and DataSpatz makes no warranty as to its use or performance. This software is not fault tolerant. DataSpatz and its suppliers do not and cannot warrant the performance or results you may obtain by using the software. except for any warranty, condition, representation or term to the extent to which the same cannot or may not be excluded or limited by law applicable to you in your jurisdiction, DataSpatz and its suppliers make no warranties conditions, representations, or terms (express or implied whether by statute, common law, custom, usage or otherwise) as to any matter including without limitation noninfringement of third party rights, merchantability, integration, satisfactory quality, or fitness for any particular purpose.
In no event will DataSpatz or its suppliers be liable to you for any damages, claims or costs whatsoever or any consequential, indirect, incidental damages, business transactions which involves money transactions, or system crash, operating system malfunction, operating system failure, virus or other bugs present on the user's system, or any lost profits or lost savings, even if an DataSpatz representative has been advised of the possibility of such loss, damages, claims or costs or for any claim by any third party. The foregoing limitations and exclusions apply to the extent permitted by applicable law in your jurisdiction. DataSpatz aggregate liability and that of its suppliers under or in connection with this agreement shall be limited to the amount paid for the software, if any. Nothing contained in this Agreement limits DataSpatz liability to you in the event of death or personal injury resulting from DataSpatz negligence or for the tort of deceit (fraud). DataSpatz is acting on behalf of its suppliers for the purpose of disclaiming, excluding and/or limiting obligations, warranties and liability as provided in this Agreement, but in no other respects and for no other purpose.
* No Reverse Engineering: Users are prohibited from reverse engineering, decompiling, or disassembling the software or any portion thereof.
* No Modifications: Users are not allowed to modify, adapt, translate, or create derivative works based upon the software.
* No Redistribution: Users may not redistribute, sell, sublicense, rent, lease, or lend the software.
* No Unauthorized Access: Users must not attempt to gain unauthorized access to the software or its related systems or networks.
* No Removal of Notices: Users must not remove or alter any copyright, trademark, or other proprietary rights notices contained in or on the software.
* No Use in High-Risk Activities: The software is not fault-tolerant and is not designed or intended for use in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the software could lead directly to death, personal injury, or severe physical or environmental damage.
* No Violation of Laws: Users must comply with all applicable laws regarding use of the software.
* No Multi-User or Network Use: Unless specifically licensed to do so, users may not use the software on a network or by multiple users simultaneously.
* No Benchmarking: Users must not use the software to benchmark or evaluate the software’s performance without prior written consent.
* No Embedded Use: Users may not embed or incorporate the software into any hardware or software system.
* No Use Outside Authorized Territory: Users may not use the software outside of the authorized territory or jurisdiction specified in the license agreement.
* "Google" is a registered trademark of Google LLC.
* "Microsoft" is a registered trademark of Microsoft Corporation.
* "SQLite" is a registered trademark of the SQLite Consortium.
* "FlatIcon" and "FreePik" are registered trademark of Freepik Company.
These Terms shall be governed by and construed in accordance with the laws of Lucknow (U.P., India) Jurisdiction. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Lucknow (U.P., India) Jurisdiction.
DataSpatz reserves the right to modify or update these Terms at any time without prior notice. It is end user responsibility to review these Terms periodically for changes.
